杭州积极推进闲置宅基地盘活利用的创新实践，开展了宅基地制度改革的“联众模式”“淳安实验”和临安天目山试点。基于杭州宅基地制度改革实践的观察发现，宅基地“三权分置”面临着实践需求与政策供给的不匹配，宅基地所有权难以显化、宅基地资格权的认定及规范保护比较模糊、宅基地使用权规范流转和盘活的市场机制及法治保障不足等困境。深入推进宅基地“三权分置”改革，促进闲置宅基地的盘活利用，应该坚持城乡融合、农村产业融合发展的视角，提高乡村治理能力，充分发挥村集体在宅基地开发利用中的主导作用，保障宅基地集体所有权的有效落实；科学界定农村宅基地“三权”之间的权责关系，显化宅基地农户资格权，建构完善的确权赋能机制；完善政策扶持、平台搭建和空间管制等政府资源配置机制，保障宅基地使用权的适度放活；推进宅基地“三权分置”改革与相关领域改革的协同融合，完善宅基地用益物权保障机制。

Hangzhou actively promoted the innovative practice of the use of spare homesteads, and explored the “Lianzhong Model”, the “Chun experiment” and the Lin’an Tianmu Mountain pilot project. Based on the observation of the practice of the housing plot system reform in Hangzhou, it is found that the “three-power split” of the homestead faces a mismatch between the demand for practice and the supply of policies. The ownership of the homestead is difficult to manifest, the identification of the right of the homestead and the protection of the standard are relatively vague, the lack of legal guarantee for the standardized circulation and activation of the market mechanism of the right to the use of homestead. In order to further promote the reform of "three rights separation" of homestead and promote the active utilization of spare homestead, we should adhere to the perspective of urban-rural integration and rural industrial integration development, improve the ability of rural governance, give full play to the leading role of village collective in the development and utilization of homestead, and ensure the effective implementation of collective ownership of homestead; scientifically define the relationship between the rights and responsibilities of the "three rights" of the rural homestead, manifest the qualification rights of the homestead farmers, construct a perfect mechanism for confirming the rights and enabling the rights; improve the government resource allocation mechanism such as policy support, platform building and space control, ensure the appropriate release of the right to use the homestead; promote the collaborative integration of the "three rights separation" reform of the homestead and the reform in related fields, and improve the use of the homestead security mechanism of property rights.
