农村土地“三权分置”后，土地经营权从土地承包经营权中分离出来，但因其定性不明确、被征收主体资格缺失及民事权益保障缺乏等原因，导致其权益无法得到有效保障。构建经营权主体权益保护机制，应将土地经营权界定为一项权利用益物权，将其纳入农地征收的客体范围，确立经营权主体在农地征收中的独立的被征收主体法律地位，并完善经营权主体权益诉讼与救济制度。
