共享宅基地使用权是宅基地“三权分置”政策下放活宅基地使用权,推动土地要素市场化配置和实现农民户有所居的关键举措。在明晰共享宅基地使用权性质内涵的基础上,健全其规制路径:一是共享宅基地使用权的设立规制,以共享宅基地使用权协议的签订制度和公示登记明确主体权利义务;二是共享宅基地使用权的用途规制,严控共享宅基地的用途,加大共享宅基地规划建造安全的监管,完善共享宅基地用途的监督管理机制;三是共享宅基地使用权的利益规制,构建共享宅基地使用权利益协调机制,以保障和促进以共享宅基地经济利益为目的的宅基地使用权制度改革持续稳定发展。

Sharing the right to use the homestead is a key measure to decentralize the right to use the living homestead, promote the market-oriented allocation of land elements and realize the housing of farmers. On the basis of clarifying the nature and connotation of the right to use shared homestead, we should improve the regulation path. The first is the regulation of the establishment of the right to use shared homestead. The signing system of the agreement on the right to use shared homestead and the public registration are used to clarify the rights and obligations of the subject. The second is to regulate the use of shared homestead, strictly control the use of shared homestead, increase the supervision of the planning and construction safety of shared homestead, and improve the supervision and management mechanism of the use of shared homestead. The third is to regulate the interests of the right to use the shared homestead, build the interest coordination mechanism of the right to use the shared homestead so as to guarantee and promote the sustainable and stable development of homestead use right system reform for the purpose of sharing the economic interests of homestead.
