《中华人民共和国土壤污染防治法》等环境法律法规初步建立了农用地土壤污染风险管控制度，但这些制度在法律概念、风险管控标准、风险决策、管控沟通以及法律责任竞合等方面存在诸多不足。在制度完善过程中，建议进一步明确农用地土壤污染风险管控法律概念，设定土壤生态风险和人体健康风险两类风险管制标准，并实现参数本地化，完善农用地土壤污染风险管控决策和沟通交流制度，进一步明确法律责任。

Environmental laws and regulations such as the Law of the People's Republic of China on the Prevention and Control of Soil Pollution have initially established soil pollution risk management and control systems for agricultural land, but these systems have many deficiencies in legal concepts, risk management and control standards, risk decision-making, management and control communication and competition and cooperation of legal responsibilities. In the process of system improvement, it is suggested to further clarify the legal concept of soil pollution risk control of agricultural land, set two risk control standards of soil ecological risk and human health risk, realize parameter localization, improve the decision-making and communication system of soil pollution risk control of agricultural land, and further clarify legal responsibilities.
