2020年修订的《预防未成年人犯罪法》以专门教育制度替换了工读教育制度与收容教养制度,但专门教育制度仍延续了工读教育制度、收容教养制度的封闭矫正模式。专门教育制度的封闭矫正模式存在偏离矫正优先的制度创设初衷、不当限制罪错未成年人人身自由、矫正效用不佳,及难以满足罪错未成年人保护需求等问题。完善专门教育制度的矫正模式,应摒弃社会管理者视角与社会防卫优先的管控立场,转而从监护人视角出发,遵循罪错未成年人矫正优先兼顾社会防卫的基本立场;从封闭管控目的与期限着手,调整封闭管控的强度;积极运用社会场域开展社会化矫正活动,提升矫正活动的科学性与效用性;加强对罪错未成年人权益的保护。

The Law on the Prevention of Juvenile Delinquency revised in 2020 replaced the work study education system and the reception education system with a special education system, but the special education system still continues the closed correction model of the work study education system and the reception education system. The closed correction model of the special education system has some problems, such as deviating from the original intention of the system of priority of correction, improperly limiting the personal freedom of the delinquent juveniles, poor correction effectiveness, and difficult to meet the protection needs of the delinquent juveniles. To improve the correction mode of the special education system, we should abandon the management and control position of the social administrator's perspective and the priority of social defense, and instead follow the basic position of giving priority to social defense in the correction of delinquent juveniles from the perspective of guardians; Adjust the intensity of closed control from the purpose and duration of closed control; Actively use the social field to carry out social correction activities, and enhance the scientific and effectiveness of correction activities; Strengthen the protection of the rights and interests of delinquent juveniles.
